Lesbian, gay, bisexual, and transgender (LGBT) people in San Marino may face legal challenges not experienced by non- LGBTQ residents. Both male and female same-sex sexual activity are legal in San Marino, but households headed by same-sex couples are not eligible for the same legal protections available to opposite-sex couples.
San Marino’s constitution prohibits discrimination based on sexual orientation, while a cyberbullying law adopted in explicitly includes protections based on sexual orientation and gender identity. However, San Marino has few other legal protections for the equal rights of LGBTIQ people.
In order to improve the legal and policy situation of LGBTI people in San Marino, ILGA-Europe recommend.
